Terms of Use

These Terms of Use govern access to and use of the Flawfence platform, published by Trackflaw SAS. By accessing the platform, you unreservedly accept these Terms of Use.

1. Definitions

  • Platform: Refers to the Flawfence SaaS solution accessible via the URL flawfence.com and its subdomains
  • Publisher: Trackflaw SAS, the company that publishes Flawfence
  • User: Any natural or legal person using the Platform
  • Customer: A User who has subscribed to a paid plan
  • Services: All the features offered by Flawfence

2. Purpose

The purpose of these Terms of Use is to define the terms and conditions of use of the Flawfence platform, as well as the rights and obligations of the parties within this framework.

Flawfence is a cybersecurity solution enabling infrastructure mapping, vulnerability detection, exploitability analysis and the generation of security reports.

3. Acceptance of the Terms of Use

Access to and use of the Platform imply full and unreserved acceptance of these Terms of Use.

The User acknowledges having read these Terms of Use and accepts them without reservation upon first connecting to the Platform. Effective use of the Service constitutes unconditional acceptance of these Terms of Use in their version then in force.

Any use of the Platform after the Terms of Use have been amended constitutes acceptance of the new terms. If the User does not accept the Terms of Use in force, they must immediately stop using the Platform and inform the Publisher.

4. Access to the Platform

4.1. Provisioning of access

Access to the Platform is not open to self-registration. User accounts are created and provisioned exclusively by the administrators of Trackflaw SAS, following the start of a trial, the subscription to a plan or the conclusion of a commercial agreement with the Customer.

Once the account has been created, the User receives their login credentials by email at the address provided upon subscription. It is their responsibility to change their password upon first connection.

4.2. Account security

The User is solely responsible for the confidentiality of their login credentials and for all activities carried out from their account. Any access to the Platform using their credentials is deemed to have been carried out by the User themselves.

In the event of loss, theft or compromise of their credentials, the User must immediately inform the Publisher at support@flawfence.com.

4.3. Conditions of access

Access to the Platform is reserved for legal or natural persons acting in a professional capacity. The User must:

  • Have the legal capacity to enter into a contract on behalf of the customer entity
  • Use the Services exclusively for legitimate professional purposes
  • Not share their credentials with third parties
  • Promptly notify the Publisher of any change affecting their access rights (departure from the company, change of role, etc.)

5. Description of the Services

Flawfence offers the following services:

  • Infrastructure mapping: Automatic discovery of domains, subdomains, IPs and external assets
  • Vulnerability scanning: Automated and continuous security analysis
  • Exploitability testing: Real-world verification of the exploitability of detected vulnerabilities
  • AI reports: Generation of customized reports powered by artificial intelligence
  • Recommendations: Remediation advice tailored to the context
  • Alerts: Real-time notifications about new threats

6. Use of the Services

6.1. Authorized use

The User undertakes to use the Services solely:

  • On assets that they own or for which they have authorization
  • In compliance with the laws and regulations in force
  • In accordance with these Terms of Use
  • For legitimate cybersecurity purposes

6.2. Prohibited use

It is strictly prohibited to:

  • Scan assets without authorization (hacking, intrusion)
  • Use the Services for illegal or malicious purposes
  • Attempt to circumvent the Platform's security measures
  • Resell or redistribute the Services without authorization
  • Use bots or scripts to automate access in an abusive manner
  • Extract, copy or reproduce the Platform's content without authorization

7. User's responsibilities

The User is solely responsible for:

  • The use they make of the Platform and the Services
  • The data they submit for analysis
  • Obtaining the necessary authorizations to scan the assets they enter
  • The consequences of any use that does not comply with these Terms of Use
  • The compliance of their use with applicable laws

8. Publisher's responsibilities

8.1. Obligations

The Publisher undertakes to:

  • Provide the Services with due diligence and professionalism
  • Maintain the availability of the Platform (excluding maintenance)
  • Ensure the security and confidentiality of data
  • Inform Users of any major changes

8.2. Limitations

The Publisher cannot be held liable for:

  • Unauthorized or abusive use of the Services by the User
  • Service interruptions related to maintenance or events of force majeure
  • The absolute accuracy of the results (scans are indicative and not exhaustive)
  • Indirect damages, loss of profits or of data
  • Actions taken on the basis of the results provided

9. Service availability

The Publisher strives to ensure maximum availability of the Platform but does not guarantee 100% availability.

Interruptions may occur for maintenance, security updates, or in the event of force majeure. The Publisher will inform Users as far as possible.

In the event of prolonged unavailability, Customers may benefit from an extension of their subscription in accordance with the terms defined in the Terms of Sale.

10. Intellectual property

All elements of the Platform (source code, design, logos, content, etc.) are protected by intellectual property rights and belong to Trackflaw SAS.

The User has a personal, non-exclusive and non-transferable right to use the Platform.

The reports and analyses generated remain the property of the Customer, but Trackflaw SAS may use anonymized data to improve the service.

11. Personal data

The processing of personal data is governed by our Privacy Policy, which complies with the GDPR.

12. Amendment of the Terms of Use

The Publisher reserves the right to amend these Terms of Use at any time. Amendments take effect as soon as they are published on the Platform.

Users will be informed of significant amendments by email or notification. Continued use after amendment constitutes acceptance of the new Terms of Use.

13. Termination and removal of access

13.1. Removal request by the User

A User wishing to have their access to the Platform removed must submit a request by email to support (support@flawfence.com) or to the account manager of their organization. The effective removal of access is carried out by the administrators of Trackflaw SAS within five (5) business days.

The removal of an individual User's access does not entail the termination of the subscription taken out by the Customer, unless otherwise agreed between the Customer and the Publisher.

13.2. Suspension or termination by the Publisher

The Publisher may suspend or terminate a User's access, without notice or compensation, in the event of:

  • Failure to comply with these Terms of Use or the applicable contractual terms
  • Fraudulent, abusive or unethical use of the Services
  • Non-payment by the Customer not remedied within the allotted time
  • Suspicious or dangerous activity, or activity likely to harm third parties
  • Termination of the subscription by the Customer

14. Governing law

These Terms of Use are governed by French law.

Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the French courts, after seeking an amicable solution.
